1. Agreement to these Terms

Spymace is operated by Magic Ingredient LLC (“we”, “us”). These Terms of Service (the “Terms”) are a binding agreement between you and us covering your access to and use of the Spymace website and all features available through it (the “Service”).

By creating an account, or by otherwise accessing or using the Service, you agree to these Terms. If you do not agree to them, do not use the Service.

Our Privacy Policy explains what personal information we collect and what we do with it. It is incorporated into these Terms by reference, and you should read it before creating an account.

Spymace is a re-creation of an early-2000s social network, built and run as a personal project. It is not affiliated with, endorsed by, or connected to MySpace, Meta Platforms, or any other social network, past or present.

2. Eligibility

You must be at least 13 years old to create an account. If the country you live in sets a higher minimum age for consenting to online services on your own behalf, you must meet that age instead.

If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

You may not use the Service if we have previously terminated your account, or if doing so would violate any law that applies to you.

3. Your account

Accounts on Spymace are created and secured through Clerk, a third-party identity provider. Clerk holds your email address and your password. We hold your @handle, your display name, and everything on your profile.

Signing in from a device we do not recognise requires your password and a verification code sent to your email address. This is on for every account and cannot be switched off.

You are responsible for:

• keeping your password confidential, and keeping control of the email account those verification codes are sent to;
• everything that happens under your account; and
• telling us promptly at support@enginyyr.com if you believe your account has been accessed without your permission.

Your @handle appears in the public address of your profile. Handles are first-come, first-served. We may reclaim a handle that impersonates another person or organisation, that was registered in bulk or for resale, or that we are legally required to release.

One person, one account. Do not create an account for anyone else, share your account, or transfer it to another person.

4. Your content

“Your Content” means everything you put on the Service: your profile text and details, blog entries, bulletins, profile comments, private messages, photo captions, custom CSS, the addresses of any images you point us at, and the YouTube video you embed.

You keep ownership of Your Content. We claim no ownership of anything you write or post.

To run the Service, we need permission to handle Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical purposes such as resizing or formatting, publish, and display Your Content, solely for the purpose of operating, maintaining and improving the Service. This licence exists only so that we can show your profile to the people you meant to show it to. It ends when you delete the content or your account, except as described in Deleting your account below.

You represent that you have the rights necessary to post Your Content and to grant this licence, and that Your Content does not infringe anyone else’s rights.

Most of what you post is public. Profiles on Spymace can be read by anyone on the internet, including people who are not signed in and search engines that index them. The Privacy Policy sets out exactly which fields are public and which are not. Do not post anything to a public area that you would not want indexed, screenshotted, or read by a stranger.

5. Acceptable use

You agree not to use the Service to:

• post content that is unlawful, defamatory, harassing, hateful, or that threatens or incites violence;
• post sexual content involving minors, or any sexual content involving a real person without their consent;
• impersonate another person or organisation, or misrepresent your affiliation with one;
• post content that infringes copyright, trademark, privacy, publicity or other rights;
• publish another person’s private information — home address, phone number, government identifiers, or similar — without their consent;
• send bulk unsolicited messages, chain messages, advertising, or the same bulletin or comment repeatedly;
• distribute malware, phishing pages, or links intended to deceive people into giving up credentials;
• attempt to gain unauthorised access to any account, server, or data, or to probe, scan or test the security of the Service except as invited by a published security policy;
• scrape or harvest data from the Service by automated means, or use it to build a competing dataset of people;
• interfere with the operation of the Service, including by overloading it, or by circumventing any rate limit or access control; or
• encourage or assist anyone else in doing any of the above.

We do not review content before it is posted. We may, but are not obliged to, review, remove, or restrict access to any content that we reasonably believe violates these Terms or the law.

6. Custom CSS, pictures, and profile videos

Spymace lets you restyle your own profile with custom CSS, upload your own pictures, and put a video on it. This is the point of the site, and it comes with terms of its own.

Custom CSS

Custom CSS you submit is filtered and re-scoped so that it applies only within your own profile area. You agree not to use custom CSS to imitate Spymace system messages or sign-in prompts, to obscure or overlay site navigation, to hide disclosures required by these Terms, or to attempt to extract information about people who view your profile. We may remove custom CSS that does any of these things, and we may change or tighten what CSS is accepted at any time, which can cause an existing profile to render differently.

Pictures you upload

You can upload photos and an avatar. Uploads go straight from your browser to our storage provider using a short-lived link we issue for one file; we then serve them from our content delivery network. We accept JPEG, PNG, GIF and WebP images up to 8 MB each. SVG is deliberately not accepted, because it can carry script.

You must own or have permission to upload every picture you post, and pictures must comply with Acceptable use above. Deleting a photo deletes the stored file as well as the database row. Bear in mind that pictures on a public profile are, like the rest of it, visible to anyone.

YouTube videos

You may set one YouTube video as your profile’s media. You paste a normal YouTube link; we keep only the video’s id and render YouTube’s own embedded player. We do not host the video, and we do not extract, convert, download or re-serve its audio — Spymace is not an “MP3 from YouTube” service and will not be turned into one.

The embed is delivered by YouTube, and everything about it is theirs: whether the video is available, whether its owner allows embedding at all, what advertising runs before or during it, and how the player behaves. A video can stop working at any time and there is nothing we can do about it. Your use of the player is also subject to YouTube’s Terms of Service and Google’s Privacy Policy.

You are responsible for having the right to share the video you embed. Do not embed a video that infringes someone’s copyright or that would break Acceptable use above.

Loading the player sends a request to YouTube from the browser of everyone who opens the profile, even though we use the privacy-enhanced youtube-nocookie.com host. The Privacy Policy explains what that means.

Pictures you link to instead

You may still point your avatar at a picture hosted somewhere else, as people did in 2005. You are responsible for having the right to display that file and for whether it stays available — if the other server removes it or blocks us, it will stop appearing, and there is nothing we can do about that.

Because a linked file loads directly from a third-party server, that server can see the IP address and browser details of everyone who views the profile. This is explained further in the Privacy Policy.

A profile may start its video automatically when opened. It only attempts to once the player is at least half visible, your browser may refuse to start it at all, and you can always stop it with YouTube’s own player controls.

7. Other people's content

Content posted by other members is theirs, not ours. We do not endorse it, and we do not verify that anything on a profile is true. Any dealings you have with another member are between the two of you.

Members may write on your profile’s comment wall, comment on your blog entries, and send you private messages. If someone is bothering you, you can remove comments left on your own wall and blog entries, and you can report them to us at support@enginyyr.com.

8. Copyright complaints

If you believe content on Spymace infringes your copyright, send a notice to support@enginyyr.com including:

1. your physical or electronic signature;
2. identification of the work you say has been infringed;
3. the address of the material on Spymace you want removed, specific enough for us to find it;
4. your name, address, telephone number and email address;
5. a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law; and
6. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

We will remove or disable access to material that is the subject of a valid notice, and we will terminate the accounts of repeat infringers. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address.

9. Suspension and termination by us

We may suspend or terminate your account, or remove content, if you materially breach these Terms, if your account is used unlawfully, or if we must do so to comply with the law or to protect the Service or other members.

Where it is reasonable to do so, we will tell you why and give you a chance to respond. Where the breach is severe or ongoing — for example, illegal content or an active attack on the Service — we may act first and explain afterwards.

We may also stop offering the Service entirely. Spymace is a personal project with no guarantee of continued operation. If we shut it down, we will give notice on the site where we reasonably can, and a period in which you can retrieve your content.

10. Deleting your account

You may stop using the Service at any time. To delete your account and the personal information associated with it, write to support@enginyyr.com from the email address on the account.

Deletion is currently handled manually, and it covers your Clerk account record, the profile, posts, comments and messages we hold, and the picture files you uploaded. See Retention and deletion in the Privacy Policy for how long this takes and what survives it.

Two things do not go away when your account does, and you should understand them before you post:

• Private messages you sent. Each side of a conversation has its own copy. Deleting a message removes it from your mailbox; the person you sent it to keeps theirs.
• Anything already copied elsewhere. Public profiles can be indexed by search engines, archived, or screenshotted by anyone who saw them. We cannot recall those copies.

Sections of these Terms that by their nature should survive termination — including Your content as it applies to content already shared, Disclaimers, Limitation of liability, Indemnification and Governing law and disputes — will do so.

11. Third-party services

The Service depends on providers we do not control, including Clerk for accounts and sign-in, our hosting, database, object storage and content delivery providers, YouTube where a member has embedded a video, and whatever servers host any images that members link to rather than upload. Their availability, and their own terms, are outside our control.

Links posted by members lead to sites we have not vetted. Following them is at your own risk.

12. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that content will be preserved. Keep your own copies of anything you would be sorry to lose. There are no backups you can call on as of right.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these Terms affects consumer rights that cannot be waived by agreement.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service, whether based in contract, tort, or any other theory, and even if we were advised of the possibility.

Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars (US$100). Spymace is free, so this will usually be the latter.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

14. Indemnification

You agree to indemnify and hold harmless Magic Ingredient LLC from any claim, demand, loss or expense, including reasonable legal fees, brought by a third party and arising out of your content, your use of the Service, or your breach of these Terms or of any law or third-party right. We will notify you of any such claim and may take over its defence at our own expense.

15. Changes to these Terms

We may update these Terms. When we make a change that materially affects your rights or obligations, we will update the “last updated” date at the top and give notice on the site, by email, or both, before the change takes effect. Continuing to use the Service after that date means you accept the updated Terms. If you do not accept them, delete your account.

16. Governing law and disputes

These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in Marion County, Indiana for any dispute arising out of or relating to these Terms or the Service.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law guarantees you the protection of your local courts and mandatory local consumer rules, nothing in this section deprives you of them.

Before filing anything, please write to support@enginyyr.com. Most problems are faster to fix that way.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service, and replace any earlier agreement on the subject.

If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary and the rest will remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor in connection with a transfer of the Service, on notice to you.
